Meeting Called to Order: 7:00 pm
Pledge of Allegiance Recited.
Members Present: Bruce Andersen, Fred Poynor, Cathy Demitroff, Mary Miller, Dan Moore, Marshall Lambertson, Roger Hubbell, Sharon Peregoy.
Excused Absence: Christy Andersen, Jessica Wooten.
Others Present: Roger Williams, Jerry Bush, Frank Walterhouse, Paul Beechcraft, Bill Sholten.
Agenda: Additions - Mary Miller made the motion to add correspondence after Approval of the Minutes from 20 January 2009; Bruce Andersen seconded the motion, All Ayes, No Nays, Motion Carried.
Approval: Mary Miller made the motion to accept the agenda with additions; Bruce Andersen seconded the motion, All Ayes, No Nays, Motion Carried.
Approval of Minutes: Mary Miller made the motion to accept the minutes from 20 January 2009 as written; Bruce Andersen seconded the motion, All Ayes, No Nays, Motion Carried.
Correspondence: Mary Miller received a letter from Northwestern Michigan Council of Government in regards to the Michigan Planning and Enabling Act of 2008. Mary Miller raised a question concerning subdivisions. Roger Williams stated that it did not affect the Homestead Inland Joint Planning Commission.
Bills: A bill was submitted by Roger Williams in the amount of $325.00 for Planning Services. Cathy Demitroff made the motion to pay all bills including expense statements; Marshall Lambertson seconded the motion, All Ayes, No Nays, Motion Carried.
New Business:
Open Public Hearing on Mass Gathering Amendment:
- Jerry Bush stated that he felt that the amendment was a little lenient.
- Mary Miller stated that her father, Elwyn Miller who could not make it to the meeting, wanted to say that he felt that 1:00 am was too late for loud music.
Closed Public Hearing.
Discussion on Amendment:
Christy Andersen sent via email two comments that she wanted brought up at the meeting. The first being that Christy is not sure if there should be a db-level in the Mass Gathering Amendment. The second comment that Christy wanted to be brought up is there should be a revision to change Article XIII, Site Plan Review to Article XIII, Section 13.4A to match the reference in C.
There was also general discussion around the board on the db-level and if there should be a set limit on it. Bill Sholten, from the Benzie Sheriff Office, joined the meeting and was asked by board member Cathy Demitroff if the Sheriff Office had a db meter. Bill said that the Department did not have a db meter.
It was agreed upon by the board that there should be no db-level set in the ordinance.
Bruce Andersen made the motion to strike the last sentence from paragraph 7; Cathy Demitroff seconded the motion, All Ayes, No Nays, Motion Carried.
Changes that were made to the Ordinance were:
Omit db-level.
Strike the last sentence of paragraph #7.
Bruce Andersen made the motion to approve the Mass Gathering Amendment with the two changes; Cathy Demitroff seconded the motion, All Ayes, No Nays, Motion Carried.
Roger Williams announced that there was an application submitted by Presidium Antrum West. They would like to change a parcel of land that they bought on US 31, just West of Reynolds Road, from Residential to Commercial. The parcel of land currently sits adjacent to Commercial land. Roger Williams has sent out an application for a Special Meeting to be held in March/April. Bruce Andersen made the motion to accept the application; Mary Miller seconded the motion, 5 Ayes, 2 Abstained, Motion Carried.
Set Date for Public Hearing: Mary Miller made the motion to have the public hearing scheduled for 17 March 2009 at Inland Township Hall. Marshall Lambertson seconded the motion. Dan Moore stated that there was not enough time to allow an ad to run in the Benzie Record paper because it is a weekly paper. Mary Miller rescinded her motion and made the motion to have the meeting held on 24 March 2009 at Inland Township Hall. Marshall Lambertson seconded the motion, All Ayes, No Nays, Motion Carried.
Printing of Master Plan and Zoning Ordinance. After discussion on this Roger Williams recommended that the copy of the Master Plan and Zoning Ordinance that he has should be sold to the person requesting a copy and that the board wait until the revision is complete before making more copies. Roger Hubbell made the motion to wait on printing until revision is done; Cathy Demitroff seconded the motion, All Ayes, No Nays, Motion Carried.
Open Public Discussion. None
Board Go Round: Fred Poynor said we have been very productive. No other board members had comments.
Adjourn: Mary Miller made the motion to adjourn; Bruce Andersen seconded the Motion, All Ayes, No Nays, Motion Carried. Next JPC Meeting is the Public Hearing on 24 March 2009 , 7:00 pm at Inland Township Hall.
